A company said no to the Pentagon, and the Pentagon tried to make it disappear.
Back in March, the Defense Department ordered every federal agency to stop using Anthropic’s products. It went further and told defense contractors not to do business with the company at all, even on work that had nothing to do with the military. The root of it traced back to February, when Dario Amodei publicly pushed back on how the Pentagon wanted to use Claude, worried about things like mass surveillance and autonomous weapons. He didn’t back down, so the government tried to bury the company in paperwork instead.
On Thursday night, a federal judge put a stop to it. U.S. District Judge Rita Lin wrote in a 59-page ruling that the whole thing was illegal and baseless, and that it violated Anthropic’s First Amendment rights along with its due process rights under the Fifth Amendment. Her line about it is the one worth remembering: the empty invocation of national security is not a blank check to punish and retaliate against government critics.
That is a big deal, and not just for Anthropic. Companies talk to the government about safety limits all the time. If speaking up about that could get a company blacklisted from federal work overnight, most companies would just stop speaking up. This ruling says that is not how the law is supposed to work.
The government is expected to appeal, so this fight is not over. But for one night, a court looked at a company that got punished for saying “we have concerns” and ruled that the punishment could not stand. That is a good sign for anyone who wants AI companies to keep pushing back when they think something is wrong, instead of quietly going along with it.
